First Time Under Under 18 Scenario


  • Driver under 18
  • Adult driver arrested for misdemeanor DUI - A.R.S. § 28-1381
  • Driver submits to tests with result equal to or greater than .08
  • Driver either submits  or must do Admin Per Se convicted or...
  • Driver is convicted of DUI
  • Driver does not have any prior DUI, Reckless Driving, or Racing offenses within the preceding five years
  • Driver has not accumulated more then 4 MVD points prior to the incident

Court/MVD Activity

  • Driver pleads or is convicted of DUI offense or...
  • Admin-Per-Se Law suspension applied

MVD Consequences

  • 90 day Admin-Per-Se suspension
  • Two year license suspension per A.R.S. § 28-3320.A.1
  • Eligible for a restricted permit for entire two years under A.R.S. § 28-3320.B
  • Eligibility for restricted permit is determined under A.R.S. § 28-1385(F)
  • Reinstatement - Reapplication fees
  • Assignment to Traffic Survival School under MVD Driver Point System
